These Terms & Conditions (“Terms”) govern your access to and use of JY Store, a marketplace platform operated by JY SOLUTION HUB SDN. BHD. (Registration No. 556148-T) (“JY Store”, “we”, “us”, “our”) at https://jysolution.my (“Platform”).
JY Store is a multi-vendor marketplace platform (similar to Shopee/Lazada/TikTok Shop) where independent third-party sellers (“Sellers”) list and sell products and services to buyers (“Buyers” or “Users”).
By accessing, browsing, registering, or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy and Refund & Returns Policy (collectively, “Platform Policies”). If you do not agree, please do not use the Platform.
1) Definitions
In these Terms, unless the context otherwise requires:
- “Account” means a registered user account on the Platform.
- “Buyer” means a User who purchases or intends to purchase goods/services.
- “Seller” means any third-party merchant/vendor listing goods/services for sale on the Platform.
- “Listing” means a product/service page posted by a Seller.
- “Order” means a Buyer’s purchase request placed through the Platform.
- “Platform Fees” means fees charged by the Platform for certain services (if applicable).
- “Digital Goods” means digital codes, vouchers, PINs, credits, subscriptions, top-ups, software keys, or similar.
- “Services” means non-physical services such as processing, booking, consulting, registration, or fulfilment support.
- “Content” includes text, images, videos, logos, descriptions, reviews, messages, and other materials on the Platform.
2) Marketplace Nature & Platform Role
2.1 Platform Provider Only
JY Store provides the marketplace technology and infrastructure to connect Buyers and Sellers. Unless clearly stated in a Listing, JY Store is not the Seller and does not own, stock, or physically inspect third-party Seller goods.
2.2 Seller Responsibility for Listings and Fulfilment
Each Seller is solely responsible for:
- Product/service descriptions, pricing, and stock accuracy;
- Delivery, fulfilment, warranties, and after-sales support;
- Compliance with applicable laws, licensing requirements, and safety standards;
- Handling returns/refunds as per Platform Policies and Seller policy (where applicable).
2.3 Platform Support
We may provide support and dispute facilitation. However, we do not guarantee outcomes of disputes and do not act as a court, arbitrator, or legal representative of any party.
3) Eligibility & Account Registration
3.1 Age Requirement
You must be at least 18 years old to create an Account or place Orders. If you are under 18, you may only use the Platform under supervision and with the consent of a parent/guardian.
3.2 Accurate Information
You agree to provide accurate, complete, and updated information (name, contact, address, etc.). You are responsible for all activities under your Account.
3.3 Account Security
You must keep your login credentials confidential. Notify us immediately if you suspect unauthorised access.
3.4 Multiple Accounts & Fraud
We may restrict or suspend Accounts involved in suspicious activity (e.g., identity misuse, payment abuse, fake orders, refund abuse).
4) Platform Rules & Acceptable Use
You agree not to:
- Violate any law or regulation;
- Post prohibited items/content (illegal, counterfeit, stolen, infringing, unsafe, hateful, obscene, or otherwise unlawful content);
- Misrepresent identity, business registration, licensing, or product authenticity;
- Manipulate reviews, ratings, or search results;
- Use bots/scrapers or attempt to hack, exploit, or bypass security;
- Harass, threaten, or abuse other Users or support staff;
- Send spam, scams, or malicious links;
- Upload viruses or harmful code.
We may remove Content or take enforcement actions as described in Section 15.
5) Product Listings, Pricing & Availability
5.1 Listing Accuracy
Sellers must ensure that Listings are accurate and not misleading. However, errors may occur (e.g., price, images, description). We may correct errors, cancel Orders, or request confirmation.
5.2 Pricing & Taxes
Prices shown may be inclusive or exclusive of taxes (e.g., SST) depending on the Seller’s configuration and legal obligations. If applicable, taxes and fees will be displayed at checkout.
5.3 Stock Availability
Stock availability is controlled by Sellers. An item may become unavailable after you place an Order; the Seller may cancel/refund in such cases.
6) Orders, Checkout & Contract
6.1 Order Placement
Placing an Order is an offer to buy. The Seller may accept or reject based on stock, verification, compliance checks, or other valid reasons.
6.2 Order Confirmation
An Order is generally confirmed when:
- Payment is successful (for prepaid methods), and
- The Seller confirms processing/fulfilment (where required).
6.3 Order Cancellation
Cancellation rules are governed by the Refund & Returns Policy, Seller policy (if applicable), and order status (e.g., shipped/delivered/digital issued).
7) Payments, Gateways & Transaction Security
7.1 Payment Processing
Payments may be processed through third-party payment gateways. You agree to comply with their terms and provide accurate payment details.
7.2 Payment Verification & Holds
To prevent fraud and chargebacks, we may:
- Require additional verification;
- Temporarily hold or review certain transactions;
- Delay fulfilment pending security checks.
7.3 Failed Payments
If payment fails, the Order may be cancelled automatically.
7.4 Chargebacks & Disputes
If you initiate a chargeback without first attempting resolution via Platform channels, we may suspend your Account and/or limit Platform use pending investigation.
8) Shipping, Delivery & Fulfilment
8.1 Delivery Responsibility
Delivery/fulfilment is primarily the Seller’s responsibility. Delivery timeframes are estimates and may be affected by courier performance, weather, customs (if any), or peak seasons.
8.2 Shipping Address
You must provide a complete and accurate shipping address and a reachable phone number. Additional charges or failed deliveries due to Buyer error are the Buyer’s responsibility.
8.3 Proof of Delivery
Courier tracking, delivery confirmation, photos, or a signed acknowledgment may be used as proof of delivery.
8.4 Split Shipments
Orders may be delivered in multiple packages if items come from different Sellers or warehouses.
9) Digital Goods & Non-Refundable Items
9.1 Digital Goods
Digital Goods (e.g., vouchers, PINs, top-ups, codes) may be delivered electronically. Once issued/delivered/used, Digital Goods are generally non-refundable except where proven invalid or undelivered due to system error.
9.2 Buyer Responsibility
You must verify denomination, region/currency (if applicable), and account/recipient details before purchase. Wrong input by the Buyer may not be refundable.
10) Returns, Refunds & After-Sales
Returns/refunds are governed by:
- Our Refund & Returns Policy;
- Seller-specific policy (where stated, and not contradicting mandatory consumer rights);
- Applicable Malaysian laws.
Sellers may be required to respond within reasonable timeframes. We may facilitate, request evidence, and decide platform-level actions (e.g., sanctions) based on documented facts.
11) User Content: Reviews, Messages, and Uploads
11.1 Content Ownership & Licence
You retain ownership of your Content (reviews, ratings, messages, photos), but you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute such Content to operate and promote the Platform.
11.2 Content Rules
Your Content must be truthful, lawful, and not infringe any rights. We may remove Content that breaches these Terms.
11.3 Review Integrity
Fake reviews, compensated reviews without disclosure, or manipulation of ratings is prohibited.
12) Intellectual Property
12.1 Platform IP
All Platform software, design, trademarks, and content (excluding Seller listings and User content) are owned by or licensed to JY Store. You may not copy, modify, distribute, or reverse engineer any part of the Platform.
12.2 Seller IP & Brand Rights
Sellers must ensure they have rights to use logos, images, and brand materials. Counterfeit and infringing items are prohibited.
13) Prohibited and Restricted Items
Sellers and Buyers must not list, sell, purchase, or promote items that are illegal or restricted under Malaysian law, including (examples):
- Counterfeit goods, stolen goods;
- Prohibited weapons;
- Illegal drugs or controlled substances;
- Materials promoting hate/violence;
- Items requiring licences/approvals without proper authorisation;
- Any item prohibited by government authorities.
We may remove such listings and report to authorities where required.
14) Seller Terms (Additional Marketplace Requirements)
If you register as a Seller, you agree that:
- You are legally authorised to operate and sell;
- You will provide accurate business and bank details;
- You will fulfil orders promptly and professionally;
- You will handle customer support and returns fairly;
- You will comply with consumer laws, product safety standards, and tax obligations;
- You will not misuse Buyer personal data (PDPA compliance).
We may require verification documents (e.g., business registration, identification) to activate or maintain Seller status.
15) Enforcement, Suspension & Termination
We may, without prior notice where appropriate:
- Remove listings or content;
- Suspend or terminate Accounts;
- Cancel orders or restrict features;
- Withhold payouts to Sellers pending investigation;
- Ban Users involved in fraud, abuse, illegal activity, or repeated policy violations.
If you believe an action is incorrect, you may contact us for review with supporting evidence.
16) Disclaimers & Limitation of Liability
16.1 As-Is Platform
The Platform is provided “as is” and “as available”. We do not guarantee uninterrupted access or error-free operation.
16.2 Third-Party Seller Responsibility
To the maximum extent permitted by law, JY Store is not liable for:
- Seller product quality, authenticity, legality, or safety;
- Seller delivery delays or non-fulfilment;
- Disputes between Buyers and Sellers;
- Indirect, incidental, consequential damages.
16.3 Maximum Liability
Where liability cannot be excluded by law, our liability is limited to the amount of Platform Fees paid by you to us (if any) in relation to the specific transaction/event, subject to applicable laws.
17) Indemnity
You agree to indemnify and hold harmless JY Store, its owners, employees, and agents from claims, losses, damages, and expenses arising from:
- Your breach of these Terms;
- Your misuse of the Platform;
- Your violation of laws or third-party rights;
- Your Content or transactions as a Seller or Buyer.
18) Privacy & Data Protection
Your use of the Platform is also governed by our Privacy Policy. Sellers must handle Buyer data responsibly and comply with PDPA and applicable laws.
19) Changes to the Terms
We may update these Terms from time to time. Updated Terms will be posted on the Platform with a revised “Last Updated” date. Continued use after changes indicates acceptance.
20) Governing Law & Dispute Resolution
These Terms are governed by the laws of Malaysia.
Where possible, disputes should be resolved through Platform support first. If unresolved, parties may pursue remedies under Malaysian courts or applicable dispute resolution channels, subject to the nature of the claim.
